Data protection Bill arms Centre with exemption powers; tech firms worried

The Personal Data Protection Bill, which was cleared by the Cabinet last week, gives the Centre powers to exempt any agency from the provisions of the legislation. The Draft Bill was circulated to Lok Sabha members on Tuesday, and is scheduled to be tabled in Parliament on Wednesday. It may possibly be referred to a joint select committee subsequently.
The exemption clauses in the Bill, reviewed by Business Standard, have left large technology companies and digital commerce firms worried about continuing their business in the country.

The Bill states that the central government can decide in the interest of “sovereignty and integrity of India, the security of the State, friendly relations with foreign States, public order” or for preventing incitement to the commission of any cognizable offence relating to certain conditions, and direct that “all or any of the provisions” of the Personal Data Protection Bill would not apply to “any agency of the Government”.
Pointing out that the Bill is very different from the first Draft under Justice B N Srikrishna committee, experts called the exemptions to government departments “overarching”. The first Draft, that was submitted to the government earlier, had disallowed processing of personal data in the interest of state security “unless it is authorised pursuant to a law, and is in accordance with the procedure established by such law, made by Parliament and is necessary for, and proportionate to, such interests being achieved”.
Apar Gupta, executive director at Internet Freedom Foundation, argued that the current Bill doesn’t deal with any kind of surveillance reform, which could include CCTV monitoring, social media monitoring, etc.
“It is not at all contemplated considering consent is a precondition to personal data collection," Gupta said.
Businesses unhappy
Digital commerce firms fear a major impact on business if the draft Data Protection Bill is passed in the current form. They fear plenty of hurdles in not only their day to day operations but also vis-à-vis their business models.
This could even hit the investment cycles for the coming year, according to industry representatives. “This is going to impact the way we work and our business models. This is a myopic way of looking at data protection. … Changing the way we work almost on a yearly basis is next to impossible. Spends on processing and handling data would sky-rocket. Many companies including ours would have to rethink investment plans,” said a senior vice president of a multinational digital commerce firm.
Analysts believe the Bill, in this form, can be a major hindrance to the idea of ease of doing business. “The bill creates a need for the data fiduciary (firm/individual) to obtain certification of the privacy by design policy from the Data Protection Authority. Such provisions lead to unnecessary compliance burden on companies and hinders the ease of doing business, which is much needed to boost the IT sector in the present economic climate,” said Salman Waris, managing partner at TechLegis Advocates & Solicitors, a law firm.
According to Waris, the provisions relating to processing data outside the country require multiple consents and approvals both from individual data principals and the government. It cannot be undertaken unless prior approval of the central government is obtained in advance, making the process cumbersome.
An executive at a large US-based technology firm, who did not wish to be named, also pointed out that the requirement for businesses to share non-personal data with the government when asked for would be a thorny issue.
The Bill says that the Central Government can, in consultation with the Data Protection Authority, direct any "data fiduciary or data processor to provide any personal data anonymised or other non-personal data to enable better targeting of delivery of services or formulation of evidence-based policies by the Central Government, in such manner as may be prescribed".
Legal expert Amber Sinha said more clarity would be required on the issue of non-personal data. In the current form, it is possible it could clash or be complicated by intellectual property laws, trade secrets, and database rights. “Essentially what we see in the Bill is that the Indian State sees data essential to its national and geopolitical ambitions and it wants to leverage the data that is available in the country for various purposes,’’ Sinha added.
Mixed response
While there has been some relaxation on the kind of personal data that can be processed outside the country, the provision got a mixed response from industry and experts.
"Depending on the nature of the data being collected, The Bill sets out rules as to where the data can be processed and stored and requires sensitive data to be stored in India while permitting such data to be processed outside India with the explicit consent of the user,’’ Atul Pandey, Partner at Khaitan & Co, has observed. The push for data localisation stems from the recent privacy concerns surrounding WhatsApp, and the desire of the government to suitably monetise the vast amounts of data being collected in India, according to Pandey. However, such data localisation measures will act as a substantial financial constraint for companies considering that fresh infrastructure will be required to be set up in India, he said. ‘’Additionally, the government will also be wary of possible reciprocal actions being undertaken by other countries, considering that companies based out of such countries will have to abide by data localisation laws in India."
An expert on the Indian information technology services industry said the Bill's provisions were adequate for IT services firms like Infosys, Wipro and so on.

Bill entails setting up of an authority for protecting personal data and prescribes stiff penalties for violations
Social media burden
Exceptions made for government use of data, verification of social media users, and the forced transfer of non-personal data represent significant threats to privacy, analysts have said. ‘’If Indians are to be truly protected, Parliament must review and address these dangerous provisions before they become law," said Udbhav Tiwari, public policy advisor at Mozilla.
The Bill has defined social media intermediaries as entities primarily or solely enabling online interaction between two or more users, while allowing them to create, upload, share, disseminate, modify or access information using its services.
The Bill places an obligation on social media companies to enable the users who register their service from India, or use their services in India, to voluntarily verify their accounts in such manner as may be prescribed. Also, any user who voluntarily verifies his account shall be provided with a "demonstrable and visible mark of verification, which shall be visible to all users of the service".
An executive with a large social media firm, who did not wish to be named, said, "in addition to the large number of consent requirements for processing personal data, we will be burdened with additional user profiling requirements as well."

Finance to foreign affairs: Modi's message in portfolios for new ministers

The story of portfolio distribution of a Council of Ministers is as much in who the prime minister picked for a particular portfolio as it is in those he did not. On Friday afternoon, the Rashtrapati Bhavan released the list of portfolios allocated to 57 ministers — 24 of cabinet rank, nine ministers of state with independent charge, and 24 ministers of state.
The list of ministers sworn in on Thursday revealed that the prime minister rewarded MPs who won their respective Lok Sabha seats against heavy odds or included those known to hail from humble backgrounds.
He dropped those perceived to be non-performers or whose integrity came into question, and also where it was felt they needed to learn a lesson or two in humility. It is, however, possible that some of the 37 dropped, especially those who have returned to the Lok Sabha, will make a comeback when the prime minister expands his cabinet. In 2014, Modi expanded his cabinet in November, when he added 21 ministers to the 40-odd who had taken oath of office on May 26 that year.
The message from portfolio distribution was that of a mix of continuity and change. As many as seven economic ministries will now see new leaders — the ministries of finance, commerce and industry, agriculture, telecommunications, civil aviation, and tourism.
In contrast, those in charge of the infrastructure ministries of railways, surface transport, roads, shipping, power, coal and petroleum in the previous government continue to remain part of the new Cabinet.

Significantly, the imprint of senior Bharatiya Janata Party (BJP) leader Arun Jaitley, who is unwell and not part of the Cabinet, is evident in portfolio distribution. Several who count him as their mentor are in charge of key portfolios, including Nirmala Sitharaman, Hardeep Puri and Anurag Thakur.
Portfolio distribution ended speculation on whether BJP President Amit Shah or party Treasurer Piyush Goyal could get finance. The prime minister opted to transfer Nirmala Sitharaman from defence to finance and corporate affairs. As in the ministry of defence, so in the finance ministry, Sitharaman follows in the footsteps of Indira Gandhi. She is only the second woman to be finance minister of India. Thakur is her minister of state.
Shah is the new home minister of the country. He was home minister in Gujarat when Modi was chief minister of the state. Rajnath Singh, number two in the government, will now helm the defence ministry. He was home minister in the previous government.
Former foreign secretary S Jaishankar is the new external affairs minister. Goyal will continue as railway minister and replaces Suresh Prabhu as minister for commerce and industry.
Nitin Gadkari will continue to handle the road transport and highways portfolio, but loses the ministry of shipping. The prime minister, however, has decided to rely on Gadkari’s experience and expertise as an entrepreneur by handing him the MSME (Micro, Small and Medium Enterprises) portfolio. With the Centre releasing the jobs data on Friday, the ministry would be crucial to spurring job growth.

Agriculture is another sector of concern. Narendra Singh Tomar replaces Radha Mohan Singh, who is no longer part of the cabinet, as agriculture minister. Tomar, rural development and panchayati raj minister in the previous government, will continue with that portfolio.
Dharmendra Pradhan will continue as oil minister, while Mahendra Nath Pandey, the BJP’s UP state unit chief, is the new minister of skill development and entrepreneurship.
The Shiv Sena, the BJP’s oldest ally, retains the heavy industries and public enterprise ministry but with the change in personnel. Arvind Sawant has replaced Anant Geete here. The prime minister has reposed faith in some ministers of state with independent charge, particularly those who implemented key schemes of his previous government.
Former bureaucrat R K Singh continues to be power minister. Puri will not only continue to handle the housing and urban affairs portfolio, but also has the additional responsibility of the ministry of civil aviation with independent charge.
Mansukh Mandavia has got independent charge of the ministry of shipping. In the previous government, he was junior minister to Gadkari in the ministry of shipping, road, transport and highways.
Gajendra Singh Shekhawat, who retained his Jodhpur seat by defeating Vaibhav Gehlot and is considered the BJP’s new star in Rajasthan, is the new cabinet minister for ‘Jal Shakti’, which comprises water resources, river development and Ganga rejuvenation. Smriti Irani, who defeated Congress President Rahul Gandhi, is now the minister handling not just textiles portfolio but also women and child development.
Ministers like Harsh Vardhan and Prakash Javadekar have returned to their initial portfolios of Modi government 1.0. Javadekar has returned to environment and forest and will also handle information and broadcasting, while Harsh Vardhan has returned to the ministry of health, but also continue to handle the science and technology portfolio. Ramesh Pokhriyal ‘Nishank’, who won from Hardwar, is the new human resource development minister. Ravi Shankar Prasad, who has debuted in the Lok Sabha after long years in the Rajya Sabha, retains his portfolios of law and justice, communications, electronics and information technology.

D V Sadananda Gowda, in recognition of the BJP’s good performance in Karnataka and with an eye on the state’s caste balance, is minister of chemicals and fertilisers, while state colleague Pralhad Joshi is the new cabinet minister for coal and mines as well as parliamentary affairs.
The late Ananth Kumar, who was also from Karnataka, was minister for both chemicals and fertilisers as well as parliamentary affairs in the previous government. Haryana, Maharashtra and Jharkhand, three states scheduled for Assembly polls by October, have representation in the council.
With an eye more on optics, several known to hail from humble backgrounds are ministers of state, including Odisha’s Pratap Chandra Sarangi, Assam’s Rameswar Teli and Rajasthan’s Kailash Choudhary.
According to an analysis by the Association for Democratic Reforms (ADR), the electoral watchdog, the number of ministers facing criminal cases has increased from 31 per cent in 2014 to 39 per cent in 2019.
Sarangi, associated with the Bajrang Dal, whose activists had killed Christian missionary Graham Staines in Odisha’s Keonjhar in 1999, leads the way. He faces seven cases of what the ADR terms “serious” Indian Penal Code sections, and 15 other cases.

43% of newly elected Lok Sabha MPs faces criminal charges: Report

Nearly half of the newly-elected Lok Sabha members have criminal charges against them, a 26 per cent increase as compared to 2014, according to the Association of Democratic Reforms.
Of the 539 winning candidates analysed by the ADR, as many as 233 MPs or 43 per cent have criminal charges.

The BJP has 116 MPs or 39 per cent of its winning candidates with criminal cases, followed by 29 MPs (57 per cent) from the Congress, 13 (81 per cent) from the JDU, 10 (43 per cent) from the DMK and nine (41 per cent) from the TMC, the ADR said.
In 2014, 185 Lok Sabha members (34 per cent) had criminal charges and 112 MPs had serious criminal cases against them. In 2009, 162 (nearly 30 per cent) out of the 543 Lok Sabha MPs had criminal charges and 14 per cent had serious criminal charges, it said.
In the new Lok Sabha, nearly 29 per cent of the cases are related to rape, murder, attempt to murder or crime against women, the non-governmental organisation said.
"There is an increase of 109 per cent (in 2019) in the number of MPs with declared serious criminal cases since 2009," it said.
Eleven winners -- five from the BJP, two from the BSP, one each from the Congress, NCP and the YSR Congress Party, and an Independent -- have murder charges against them, the ADR said.
Pragya Singh Thakur, the newly-elected BJP MP from Bhopal, faces terror charges in connection with the 2008 Malegaon blasts. The Bharatiya Janata Party has faced a lot of criticism for fielding her.
Moreover, 29 winners have declared cases related to hate speech, it said.
Dean Kuriakose from the Congress, who won from the Idukki constituency in Kerala, has 204 criminal cases against him, including culpable homicide, house trespass, robbery, criminal intimidation, it added.

PM Modi to stake claim to form new Govt, meets President this evening

The prime minister is likely to call on the President at around 8 pm and before that, leaders of the National Democratic Alliance (NDA) would meet Kovind at around 7 pm, the sources said.

The NDA returned to power with a massive majority in the Lok Sabha elections with the BJP alone bagging 303 of total 542 seats contested. Elections were held in 542 of the 543 seats. The election in Vellore Lok Sabha seat was cancelled by the EC citing abuse of money power.
Asked whether foreign dignitaries would be invited to the swearing-in ceremony, the sources said, "As of now there is no such information. We will share the details once a decision is taken."
Modi had invited the Heads of the SAARC nations to his swearing-in ceremony as Prime Minister in 2014.
Meanwhile, the full Election Commission on Saturday called on President Kovind and handed over the list of 542 newly-elected members of the Lok Sabha that will enable him to initiate the formal process of new government formation.

Exit poll results 2019 LIVE: Over 300 seats for NDA; Modi set for 2nd term

The seventh phase of Lok Sabha elections 2019 has concluded, bringing the curtains on the world's largest democratic exercise, which went on for over five weeks. Today, most exit polls forecast a majority for the ruling BJP-led NDA in Lok Sabha polls with varying numbers as the seven-phase polling in the general elections ended Sunday.
Two exit polls telecast by Times Now gave the NDA 296 and 306 seats, while they projected 126 and 132 for the Congress-led UPA. The CVoter-Republic exit poll has forecast 287 and 128 seats for the NDA and UPA respectively.
However, Neta-News X predicted that the National Democratic Alliance could fall short of the majority and win 242 seats. It gave the UPA 164 seats. Elections to 542 seats of the Lok Sabha ended Sunday. The majority mark is 272. The counting of votes will begin at 8 am on May 23. An exit poll on News 18 forecast that the NDA will win 292-312 seats while it gave 62-72 seats for the UPA. Many exit polls predicted that SP-BSP alliance in Uttar Pradesh is likely to trump the BJP in the country's politically most crucial state. The BJP had won 71 and its ally Apna Dal two of its 80 seats in 2014.

An election exit poll is a poll among voters conducted immediately after they leave their polling stations. It is conducted by a number of organisations and is considered an indicator to which party might form the next government.

Lok Sabha exit polls: It's advantage TMC in Bengal, but BJP gaining seats

Lok Sabha elections 2019: How reliable are exit polls?
While exit polls should be seen as an indicator, their veracity can only be judged by their proximity to the actual results. In recent times, there have been several instances of exit polls predicting results that have been very far from the ac tual verdict. For example, in 2004, the exit polls wrongly predicted BJP-led NDA coalition winning again. In 2009, again, Congress-led UPA's seat share was underestimated. In 2014, too, the actual seat tally of of the BJP-led NDA came to be much bigger than those predicted by the exit polls.

Lok Sabha Election 2019 LIVE: 10.6% voter turnout in Bihar, 10.5% in Bengal

The seven-phase Lok Sabha elections, one of the most bitterly fought ever, will come to a close today. In the last phase, polling is being held in 59 constituencies, including Varanasi, where Prime Minister Narendra Modi is seeking to retain his seat.
Polling is underway in all 13 seats in Punjab, besides another 13 in Uttar Pradesh, nine in West Bengal, eight each in Bihar and Madhya Pradesh, all four in Himachal Pradesh, three in Jharkhand, and the lone seat of Chandigarh.
Over 100 million voters are expected to decide the fate of 918 candidates in this phase. The Election Commission of India (ECI) set up more than 112,000 polling stations for the smooth conduct of polls. Counting of votes for all phases will be taken up on May 23.
Prime Minister Narendra Modi, Union Minister Ravi Shankar Prasad, BJP lawmaker and veteran actress Kirron Kher, Congress leader Shatrughan Sinha, Union Minister and SAD leader Harsimrat Kaur Badal and actor-turned-politician Sunny Deol are among the prominent candidates in fray in Phase-7 national election.
Among other important leaders are former Punjab Chief Minister Sukhbir Singh Badal, RJD leader Misa Bharti, Union Minister and BJP leader Ram Kripal Yadav, former Lok Sabha speaker Meira Kumar and Bhojpuri actor-turned politician Ravi Kishan who is the BJP candidate from Gorakhpur.
Also, a bypoll in Panaji, necessitated by the death of former Chief Minister Manohar Parrikar in March, will be held today.

Lok Sabha election 2019 Phase 7: 10.48 per cent polling till 9 am in Jharkhand
An estimated 10.48 per cent of the total 45,64,681 voters exercised their franchise till 9 am in the final phase of polling for the three Lok Sabha seats in Jharkhand on Sunday, an Election Commission official said.

The electorate also include 22,00,119 female and 21 third gender voters.

There are a total 42 candidates in the three seats, including former chief minister and JMM chief Shibu Soren who is contesting from the Dumka seat.

The other two constituencies where polling is being held are Rajmahal and Godda.

A large number of women and first time voters were seen in queues before the booths as the polling began at 7 am. Polling will end at 4 pm.

Elderly voters were seen escorted by their relatives to the booth to help them cast their votes.

Prime Minister Narendra Modi on Sunday said he had a master plan for the development of Kedarnath as he offered prayers at the shrine on the last day of voting for the Lok Sabha elections.

Modi, who stayed in a cave to meditate at the shrine, said: “Mera saubhagya raha hai ki adhyatmik chetna ki bhoomi pe jaane ka mujhe kai varshon se awsar milta raha hai. Yahan ka mera jo development mission hai usmein prakriti, paryavaran aur paryatan hain (It has been my fortune that I have been able to visit this place year after year. My development mission for Kedarnath has nature, environment and tourism).”

Talking about the culmination of the mammoth election exercise, the Prime Minister thanked the Election Commission as well as the media for their efforts. When quizzed about his prayers and if he asked for a return to power, Modi said: “I never ask god for anything because I believe he has given us the capacity to give.”

Madhya Pradesh Lok Sabha election 2019: Polling underway in 8 seats of MP
Polling for eight seats in the fourth and final phase of Lok Sabha elections in Madhya Pradesh began at 7 am today.

Prominent candidates in the fray are former Union ministers Kantilal Bhuria and Arun Yadav of the Congress, who are contesting from Ratlam and Khandwa seats, respectively.

Polling was going on peacefully in the eight seats of Dewas, Ujjain, Mandsaur, Ratlam, Dhar, Indore, Khargone and Khandwa, MP's Chief Electoral Officer V L Kantha Rao told PTI.

"So far, there was no report of any problem in the polling process," he said.

Long queues were seen at several booths in these eight constituencies, all currently held by the BJP. Read on...

Stage set for last phase of Lok Sabha polls to be held in 59 constituencies

The seven-phase Lok Sabha elections, one of the most bitterly fought in recent memory, will come to a close Sunday when polling will be held in 59 constituencies including in Varanasi where Prime Minister Narendra Modi is seeking to retain the seat.
Polling will be held in all 13 seats in Punjab and an equal number of seats in Uttar Pradesh, nine in West Bengal, eight seats each in Bihar and Madhya Pradesh, four in Himachal Pradesh, three in Jharkhand and the lone seat Chandigarh.

Over 10.01 crore voters are expected to decide the fate of 918 candidates. The Election Commission has set up more than 1.12 lakh polling stations for smooth conduct of polls.
On Sunday, a bypoll will be held in Panaji, necessitated due to the death of former chief minister Manohar Parrikar in March. Bye-elections will also be held in four assembly constituencies of Tamil Nadu -- Sulur, Aravakurichi, Ottapidaram (SC) and Thiruparankundram.
Counting of votes will be taken up on May 23.
An average of 66.88 per cent voters exercised their franchise in the last six phases. The whole elections were spread over 38 days.
In Uttar Pradesh, all eyes will be on Varanasi, where besides Modi, 25 other candidates are in fray. Modi's main challengers are Congress's Ajay Rai and SP-BSP grand alliance's nominee Shalini Yadav.
Union minister Manoj Sinha, Uttar Pradesh BJP chief Mahendra Nath Pandey are seeking re-election from Ghazipur and Chandauli, respectively.
The BJP is contesting 11 Lok Sabha seats in this phase, while its ally Apna Dal (Sonelal) is contesting Mirzapur, currently held by Union minister Anupriya Patel, and Robertsganj.
SAD chief Sukhbir Singh Badal and union ministers Harsimrat Kaur Badal and Hardeep Singh Puri are among the 278 candidates including 24 women whose fate will be decided in Punjab on Sunday.
Besides Punjab, more than 6 lakh voters in the union territory of Chandigarh will choose between sitting MP and BJP candidate Kirron Kher and former railway minister and Congress candidate Pawan Kumar Bansal.
Actor turned politician Sunny Deol, Punjab Congress chief Sunil Jakhar, Aam Aadmi Party's Punjab unit chief Bhagwant Mann are among other prominent candidates in the fray.
On most of the 13 seats, the contest appears to be a direct fight between the Congress and Shiromani Akali Dal-BJP alliance.
A conglomeration of several political outfits, the Punjab Democratic Alliance (PDA) led by AAP rebel Sukhpal Singh Khaira, is also contesting on all 13 seats while SAD (Taksali), breakaway faction of SAD, has fielded one candidate from Anandpur Sahib.
In 2014, the AAP and the SAD had won four seats each, the Congress three and the BJP two.
An electorate of 1,49,63,064 will decide the fate of 111 candidates in nine seats of West Bengal -- Kolkata North and Kolkata South, Dum Dum, Barasat, Basirhat, Jadavpur, Diamond Harbour, Jaynagar (SC) and Mathurapur (SC).
Eight seats, barring Jadavpur, will witness a contest among the Trinamool Congress, the BJP, the Congress and the Left Front. The Congress has given the Jadavpur seat a miss.
The nine constituencies are spread across the three districts of Kolkata, South and North 24 Parganas.
The high-voltage campaign for the final phase saw poll meetings by Prime Minister Narendra Modi, BJP president Amit Shah, Uttar Pradesh Chief Minister Yogi Adityanath, Congress leader Sachin Pilot and West Bengal Chief Minister and TMC chief Mamata Banerjee.
Shah's roadshow in the city on Tuesday was marred by violence and destruction of social reformer Ishwar Chandra Vidyasagar's bust in a college in north Kolkata.
In a first such action in India's electoral history, the Election Commission ordered campaigning in the nine West Bengal constituencies to end at 10 pm on Thursday, instead of 6 pm on Friday, in the wake of the violence between the BJP and the TMC during Shah's roadshow.
As many as four Union ministers -- Ravi Shankar Prasad, Ram Kripal Yadav, RK Singh and Ashwini Kumar Choubey -- are among the 157 candidates in Bihar.
Seven of these seats were won by the NDA last time, five by the BJP and two by the RLSP, which is now with the "Mahagathbandhan".
One was bagged by the JD(U) headed by Chief Minister Nitish Kumar, which then fought separately but is now back with the NDA.
By-poll will also be held for the Dehri Assembly seat.
The most keenly-watched contest is in Patna Sahib where Prasad, one of the most prominent members of the Narendra Modi cabinet, is seeking entry into the Lok Sabha. He is pitted against Shatrughan Sinha - the actor-turned-politician, who won it on both occasions for the BJP and is now in the fray as the Congress candidate.
The electoral fortunes of 42 candidates including that of former chief minister and Union minister Shibu Soren will be decided on Sunday in Jharkhand.
Soren, the chief of Jharkhand Mukti Morcha and a eighth term sitting MP is in the fray from Dumka seat once again. He is crossing swords with BJP's Sunil Soren. The JMM leader had defeated his BJP challenger twice in 2009 and 2014.
Dewas, Ujjain, Mandsaur, Ratlam, Dhar, Indore, Khargone and Khandwa seats in Madhya Pradesh, all currently held by the BJP, will go to polls in Madhya Pradesh. Former Union ministers Kantilal Bhuria, Arun Yadav are in the fray from Ratlam and Khandwa, the latter seeing a tough fight between Yadav and ex-MP BJP chief Nandkumar Singh Chauhan.
Polling will also be held in all four Lok Sabha constituencies in Himachal Pradesh where as many as 45 candidates, including five legislators, are in the fray.

Lok Sabha Elections Phase 6 LIVE: One killed in poll violence in Bengal

Delhi candidates and political leaders show their inked fingers after casting their votes in the sixth phase of Lok Sabha elections
Voting for Lok Sabha elections 2019 Phase 6 is underway in 59 parliamentary seats across seven states of India today. Polling will conclude at 5 pm. In today's polling, over 101.7 million voters will decide the fate of 979 candidates.
Some of the key candidates in the fray in this phase are Maneka Gandhi, Varun Gandhi, Rita Bahuguna Joshi, Gautam Gambhir, Meenakshi Lekhi and Sadhvi Pragya (from BJP), Digvijaya Singh, Jyotiraditya Scindia, Sheila Dikshit, Ajay Maken, Bhupinder Singh Hooda and Kirti Azad (Congress), Akhilesh Yadav (Samajwadi Party), Manas Bhunia (Trinamool Congress), and Atishi, Raghav Chadha and Dilip Pandey (AAP).
The voting for Phase 6 of Lok Sabha elections will take place in Bihar (8 seats), Jharkhand (4), Madhya Pradesh (8), Uttar Pradesh (14), West Bengal (8), Haryana (10), and Delhi (7).
The Election Commission of India has set up over 113,000 polling stations for smooth conduct of the polls. While the poll timings are 7 am to 6 pm in most constituencies, voting will end early at 4 pm in Jharkhand and some parts of Bihar for security reasons.
Results of Lok Sabha elections 2019 for all 543 parliamentary seats and Assembly elections in four states will be declared on May 23.

One killed, many injured as violence hits Bengal in LS polls
A BJP activist was killed in West Bengal's Jhargram district early on Sunday as a number of violent incidents and clashes rocked the state in the sixth phase of the Lok Sabha polls.

More than 60,000 personnel to be on toes on polling day in Delhi tomorrow

More than 60,000 security personnel, including the Home Guards and paramilitary forces, have been deployed across the city a day before the Lok Sabha elections here.
Delhi Police Commissioner Amulya Patnaik told PTI that elaborate arrangements, according to the instructions of the Election Commission of India, are in place to ensure no anti-social element causes any menace.

Security personnel have been deployed at polling booths and special reserve parties and policemen are patrolling vulnerable areas, the police said.

The Police Control Room Unit will also stay alert to calls of any complaints being made, specially relating to the election process, they added.
"The model code of conduct is being strictly enforced. There is a special watch on border areas to foil any attempt to infiltrate by anti-social elements to cause disruption. There will be strict vigil to ensure malpractices like liquor peddling and movement of anti-social elements with a purpose to influence voters do not happen," Patnaik said.

Anti-terror measures are also in place and special arrangements have been made to check sabotage of polling booths, including election rigging, the Deputy Commissioner of Police (New Delhi) and the spokesperson of the force, Madhur Verma, said.
The officer added that extra picket teams have been deployed in border areas too. "Briefings were held with the polling staff on dispersal of EVMs and the routes to be taken to ensure no rigging of EVMs happens on the way. Night patrolling has been intensified to check use of muscle power and money to lure voters," Verma said.
Adequate security forces have been deployed at identified polling stations with Quick Reaction Teams placed at congested areas across the district in case of any emergency, another official added.
The police have registered 1,378 FIRs and arrested 1,381 people under the Excise Act. They have also seized 691 unlicensed arms and weapons, and 3,007 cartridges and explosives, a statement said.

It said 1,14,482 people have been booked till date under various sections of the CrPC and the Delhi Police Act.
A police official said there are three facets to the security apparatus at places where Electronic Voting Machines (EVMs) are kept, border checking, and law and order arrangements for polling and counting days.
The officer said police will be involved in enforcing a dry day, which came into effect from 5 pm on Friday.
Another official said 39,000 police personnel and 13,000 Home Guards will be involved in ensuring the security of polling booths.
They will be supplemented by police personnel from the Police Control Room and the traffic unit, along with 47 companies of paramilitary personnel, another official added. Each company comprises 100 personnel.
All seven Lok Sabha seats in Delhi will head for polling on Sunday.

Lok Sabha elections 2019: 66% voter turnout recorded in phase 2, says EC

Sixty-six per cent voter turnout was recorded in the second phase of Lok Sabha polls on Thursday, Senior Deputy Election Commissioner Umesh Sinha said.
The elections were marred by sporadic incidents of violence in West Bengal and Manipur and EVM glitches. There were also reports of EVM malfunctioning in some seats.
Puducherry saw a high voter turnout of 78 per cent while in Manipur, the polling percentage was nearly 75, sources in the election office said. Srin­agar, which in 2014 witnessed the lowest voter turnout in the country at 25.86 per cent, saw 12.43 per cent polling, with highest 17.1 per cent recorded in Shia-dominated Budgam district till 3 pm.

No untoward incident was reported during polling which was being held amid tight security due to militant threats and a boycott call by separatists in Kashmir. Udhampur Lok Sabha constituency recorded 58.13 percent polling.In Tamil Nadu, where polling is being held in the maximum 38 seats, the voter turnout was 52.02 per cent at 3 pm.
Chief Electoral Officer Satyabr­ata Sahoo said no reports of booth capturing or any other untoward incident reg­arding law and order has been received so far.
Karur recorded the highest voter turnout at 56.85 per cent while Chennai Central clocked the lowest at 45.65 per cent, according to the EC data. Elections for the 18 assembly segments where bypolls are being held saw a turnout of 55.97 per cent at 3 pm. Besides Tamil Nadu, polling is being held in 14 seats in Karnataka, 10 in Maha­rashtra, eight in Uttar Prad­esh, five each in Assam, Bihar and Odisha, three each in Chhattisgarh and West Bengal, two in Jammu and Kashmir and one seat each in Manipur and Puducherry besides 35 assembly constituencies in Odisha.

Polling in Tamil Nadu's Vellore LS seat was cancelled on Tuesday by the EC following recovery of cash allegedly from an associate of a DMK leader. The EC also announced postponement of polling in Tripura (East) Lok Sabha seat to the third phase on April 23, saying the prevailing law-and-order situation there is not conducive for holding free and fair polls. Isolated incidents of violence, road blockades, bombings and police firing marred polling in the three Lok Sabha constituencies in West Bengal with 65.43 per cent of voter turnout recorded till 3 pm.
Police fired in the air and burst tear gas shells to control a mob, who threw stones at them in Raiganj Lok Sabha constituency in West Bengal. Bombs were also hurled by unknown miscreants in Chopra area, a senior EC official said.
A reporter and a camera person of a local news channel were allegedly manhandled when they went to cover polling at Kataphulbari in Raiganj constituency. CPI(M) candidate from Raiganj, Md Salim, claimed his car was attacked by unknown persons when he went to a polling booth at Islampur. Special Police Observer Vivek Dubey, however, described the voting as "more or less peaceful" with a few isolated incidents reported from places in the three seats.

An average 57.22 per cent polling was recorded till 5 pm in 10 constituencies of Maharashtra.
Around 59.72 per cent polling was recorded till 3 pm in Chhattisgarh's three Lok Sabha seats, all having Naxal presence, amid tight security.
According to police, except for an IED blast triggered by Maoists in Mohla-Manpur assembly segment of Rajnandgaon Lok Sabha constituency, no other untoward incident was reported in the poll-bound areas.
About 53 per cent voters exercised their franchise till 3 pm in five Odisha Lok Sabha and 35 assembly seats, some of them in Naxal-affected areas.
Karnataka saw a turnout of 61.84 per cent till 5 pm. In Assam, Karimganj recorded the highest polling of 63.66 per cent till 3 pm followed by Mangaldoi and Autonomous district- both at 62.7 per cent, Silchar with 57.06 and Nowgong with the lowest at 56.78 per cent. The five seats in Bihar saw an estimated 45.77 per cent voting till 3 pm.
The Election Commission put the overall voter turnout in Uttar Pradesh at 50.39 per cent till 3 pm.
Lok Sabha polls are being held in seven-phases for 543 seats on April 11, April 18, April 23, April 29, May 6, May 12 and May 19, and counting will be on May 23.

Lok Sabha elections in Tamil Nadu's Vellore cancelled after cash haul

The April 18 Lok Sabha elections in Tamil Nadu's Vellore was cancelled on Tuesday after crores in cash was seized in the constituency in the past few weeks.
The Election Commission had two days ago recommended to the President that elections in Vellore be cancelled citing the suspected use of money power to influence voters after huge cash seizures from DMK leaders over the last two weeks, the Indian Express reported.

The Income Tax department seized several crores of rupees from the premises of the DMK candidate in Vellore and party workers .

LS polls: Left names 25 candidates for WB, leaves 17 seats for Congress

The CPI(M)-led Left Front announced its first list of candidates for 25 seats in West Bengal for the upcoming Lok Sabha polls on Friday, leaving 17 constituencies for the Congress.
The list has four women and five Muslim candidates.

The Left Front has nominated former Kolkata mayor and CPI(M) leader Bikas Ranjan Bhattacharya from the Jadavpur Lok Sabha constituency. He will be pitted against Trinamool Congress's (TMC) Mimi Chakraborty, a popular film actress.
The state Congress leadership, which was keen on contesting the Purulia and Barasat seats, said everyone should be flexible in an adjustment.
For the first time, the Left Front has opted for a seat-sharing deal with its once arch rival -- the Congress -- for the Lok Sabha polls in the state.
Earlier in 2016, against the wishes of its Left allies, the Communist Party of India (Marxist) had entered into a seat-sharing deal with the Congress for the state Assembly polls. Struck in a hurried manner, the deal had failed to evoke mass support.
In a press statement, West Bengal Left Front chairman Biman Bose said the 25 Lok Sabha seats included Raiganj and Murshidabad, for which the candidates were declared earlier.
"For the remaining 17 seats, some will be contested by the Congress and some by the Left Front. In some seats, there might be candidates who would be jointly supported by the Congress and the Left Front," the statement added.
The state CPI(M) leadership is in a fix over choosing between the Congress and its Left Front allies, who are not willing to leave the Purulia and Barasat seats, which they have been contesting for decades.
The Congress is keen on contesting these two seats, leading to an impasse in the seat-sharing talks.
Bose said it was decided at the Left Front meeting that the CPI and the Forward Bloc would contest Purulia and Barasat respectively, but if the Congress wanted to field its candidates in these two seats, they could go ahead.
Reacting to the development, state Congress chief Somen Mitra said they would discuss the matter within the party and announce their list very soon.
"We will inform the party high-command about it. We will discuss the matter and announce our list. They (Left) did whatever they felt right and we will do whatever we feel right," he said.
The CPI(M) and the Congress have agreed on a seat-sharing adjustment to stop the march of the ruling TMC and a resurgent Bharatiya Janata Party (BJP) in Bengal.
The Left Front has nominated Mohammed Salim and Badaruddoza Khan from Raiganj and Murshidabad respectively. Both of them had won these seats in 2014.
In Diamond Harbour, senior CPI(M) leader Fuad Halim will be pitted against sitting TMC MP and Chief Minister Mamata Banerjee's nephew Abhishek Banerjee.
In the Dum Dum Lok Sabha seat, the Left Front has fielded CPI(M) leader Nepaldeb Bhattacharya against sitting TMC MP Sougata Roy.
The Left Front has also nominated Rejaul Karim, a medical practitioner, from the Birbhum seat. A doctor at a government hospital, Karim was suspended by the TMC government for participating in a rally against it in November last year.
The seven-phased Lok Sabha polls will be held from April 11 to May 19 and the counting of votes will be taken up on May 23. West Bengal will go to the polls in all the seven phases.

Lok Sabha polls to be held from April 11 to May 19, counting on May 23

Lok Sabha elections 2019 will be held in seven phases from April 11 to May 19, the Election Commission of India announced on Sunday, setting up a contest between Prime Minister Narendra Modi, who is seeking a second term, and the Opposition parties trying to stitch up a coalition against his Bharatiya Janata Party (BJP).
Votes cast in the seven phases of polls across India -- on April 11, 18, 23 and 29 and May 6, 12 and 19 -- will be counted on May 23, said Chief Election Commissioner Sunil Arora. Voting in Uttar Pradesh, Bihar and West Bengal will be spread across the seven-phase election.

Elections for the Assemblies of Andhra Pradesh, Sikkim, Arunachal Pradesh and Odisha will be held simultaneously along with Lok Sabha polls. Jammu and Kashmir will vote for the Lok Sabha in five phases, but there will be no Assembly elections in the militancy-affected state for now, according to Arora.

Opinion polls show Modi's BIP, which secured the biggest electoral victory in three decades in 2014, might be the single largest party but fall short of a majority, Bloomberg News reported.
Modi is said to have lately faced some slide in popularity over rising concerns about lack of job creation and rural distress.
"The festival of democracy, elections, are here. I urge my fellow Indians to enrich the 2019 Lok Sabha elections with their active participation,” said Modi on Twitter after the poll schedule was announced.
In the run-up to the elections, the Congress, the country’s main Opposition party, has pledged a one-time farm loan write-off, and minimum income guarantee to the poor, and blamed the Modi government for alleged corruption in the Rafale fighter plane deal.

Election Commission ready to announce Lok Sabha poll schedule 'any day'

The Election Commission is prepared to list dates for Lok Sabha elections "any day" and an announcement could come over the weekend or by Tuesday, said a senior official of the organisation.
The elections are likely to be held over seven or eight phases in April-May, sources said on Thursday.

The announcement of dates will be followed by a meeting of election observers next week for the first and second phase of polling.
A notification for the first phase could be issued by the end of March for voting in early April, sources said.
There is a strong possibility that the commission may go by the precedent and hold assembly elections in Andhra Pradesh, Odisha, Sikkim and Arunachal Pradesh along with the Lok Sabha polls.
The commission has to decide about Jammu and Kashmir where there the Assembly has been dissolved and the law says elections must be held within a six-month period, which will end in May.
While there is a view that the Jammu and Kashmir assembly elections can be held along with the Lok Sabha polls, but a lot depends on the complex security situation in the state given the heightened tension along the India-Pakistan border.
While the Centre and the state administration, being managed by the Centre-appointed governor, are against holding the two elections together, all political parties there favoured simultaneous polls during a meeting with the Election Commission earlier this week.
The J-K assembly's six-year term was to end on March 16, 2021, but it got dissolved after a ruling coalition between the PDP and the BJP fell apart. The other state assemblies and Lok Sabha have five-year terms.
While the term of the Sikkim Assembly ends on May 27, 2019, the terms of Andhra Pradesh, Odisha and Arunachal Pradesh assemblies end on June 18, June 11 and June 1 respectively.
The Commission has held several review meetings across the country in last few weeks to gear up its machinery.
The required electronic voting machines and paper trail machines are in place to be deployed in nearly 10 lakh polling stations across 543 Lok Sabha constituencies.
This is a high probability of the elections being spread across 7-8 phases this time. In 2004, the Commission had announced four-phase Lok Sabha polls on February 29. While the first date of polling was April 20 and the last date was May 10.
In 2009, the commission had announced Lok Sabha poll scheduled on March 2. The five-phase polls began on April 16 and ended on May 13.
In 2014, the commission had announced the election schedule on March 5 and the nine-phase electoral exercise was spread across April and May.
While the first phase polling was on April 7, the last phase was on May 12.
The term of the present Lok Sabha ends on June 3.

Lok Sabha for the first time in the winter session saw no protests by Opposition parties in the Well during the Question Hour on Tuesday, the last day of the session in the Lower House.
The government on Tuesday introduced a Constitution amendment Bill in the Lok Sabha that seeks to provide 10 per cent reservation for economically backward sections in the general category in government jobs and higher educational institutions.
The introduction of the Constitution (124th Amendment) Bill, 2019 by Social Justice and Empowerment Minister Thawar Chand Gehlot was a smooth affair in the House with no member raising any objection.
The Lok Sabha on Tuesday passed the Citizenship Amendment Bill, 2019, that seeks to remove hurdles in eligible migrants from six minority groups from Bangladesh, Pakistan and Afghanistan getting Indian citizenship despite opposition by various political parties including Congress and Trinamool Congress. As the Congress and the TMC's demand for sending the Bill again to a parliamentary panel was rejected by the government, they staged a walkout.
The Winter session of Lok Sabha, which began on December 11, is slated to conclude on Tuesday.

Meanwhile, the Rajya Sabha on Tuesday witnessed frequent adjournments, washing out proceeding before adjourning for the day even as the House extended its sitting by a day till Wednesday.

SP, BSP agree on alliance for LS polls, to make formal announcement soon

The Samajwadi Party and the Bahujan Samaj Party have agreed to an alliance in Uttar Pradesh ahead of the Lok Sabha elections, an SP leader said Saturday.

A formal announcement on the "gathbandhan" between the two opposition parties may take place later this month, SP's national spokesperson Rajendra Chaudhary told PTI.
There is no official word yet if the Congress too would be part of the UP alliance.

The state BJP called the development “opportunistic” and “anti-people”.
Chaudhary said Samajwadi Party president Akhilesh Yadav and BSP chief Mayawati had given their go-ahead for the alliance after a series of meetings between them.

"There has been an in-principle approval for the gathbandhan. And there is a possibility that an announcement in this regard will be made this month," Chaudhary said.
"A number of meetings between SP chief Akhilesh Yadav and BSP supremo Mayawati have already been held. Yesterday too, both leaders met in Delhi," he said "Talks are going on to accommodate some smaller parties in the alliance," he said.
He admitted that the Rashtriya Lok Dal (RLD), which has a presence in western UP, is among these parties.

When asked about the possible inclusion of Congress in the UP alliance, Chaudhary said, "This will be decided by Akhilesh Yadav and Mayawati." But he added the SP and the BSP will not field candidates in Amethi and Raebareli, leaving these Lok Sabha constituencies for Congress president Rahul Gandhi and United Progressive Alliance chief Sonia Gandhi.
UP Congress chief Raj Babbar argued there had been no announcement after the meeting between the presidents of the two parties, and it was not for him to comment on it. "We are yet to get any instructions or directions from our central leadership," he told PTI.
Akhilesh Yadav had recently expressed displeasure against the Congress for not including its lone MLA in the new Madhya Pradesh ministry headed by Kamal Nath.

BSP leader Mayawati too has said it may withdraw its outside support to the Congress in Madhya Pradesh and Rajasthan if the cases against Dalits lodged during a protest last year are not withdrawn.
The BJP dubbed the coming closer of the SP and the BSP “opportunistic”. "This is an opportunistic alliance and it is completely anti-people. The BJP will register massive wins in UP in the 2019 Lok Sabha elections," UP BJP spokesperson Hero Bajpai told reporters here.
Politically crucial Uttar Pradesh sends 80 MPs to the Lok Sabha.
The opposition parties defeated the ruling Bharatiya Janata Party in three Lok Sabha bypolls in the state last year.
In the Kairana Lok Sabha by-elections in May, the BJP lost to the joint opposition candidate, RLD's Tabassum Hasan.
The seat had fallen vacant following the death of the BJP candidate Mriganka Singh's father Hukum Singh.
Tabassum Hasan was supported by the Congress, the SP and the BSP.
In March, the BJP lost the Lok Sabha bypolls in Gorakhpur and Phulpur.
In the last parliamentary elections in 2014, the BJP won 71 seats in the state, securing 42.63 per cent of the votes. BJP ally Apna Dal bagged two more.
Samajwadi Party won five seats with a vote share of 22.35 per cent. The BSP did not win any seat while securing 19.77 per cent votes.
Congress registered wins on two UP seats in 2014, bagging 7.53 per cent of the votes.

Less than 60% engineers, MBA grads get campus placements: Parliament told

The average of students getting campus placements from management, technical and engineering institutions is less than 60 per cent, Parliament was informed on Monday.
The information was shared by Union Minister of State for HRD Satya Pal Singh in response to a written question in Lok Sabha.

"As per the placement data of students available with All India Council for Technical Education (AICTE), average campus placement of the graduates from management, technical and engineering institutions has not reached up to 60 per cent," Singh said.
"To encourage 100 per cent placements to the graduates, AICTE has launched outcome-based model curriculum for UG and PG level courses in engineering and management programmes to make it industry oriented. Institutions have now been made responsible for arranging internships of their students so as to enhance their employability," he added.

The Lok Sabha on Friday took up a no-confidence motion against the government for debate and voting, two days after the start of the monsoon session. Top guns of the Opposition and the Bharatiya Janata Party (BJP) took part in the debate, which will conclude with a reply from Prime Minister Narendra Modi. Congress President Rahul Gandhi also gave a fiery speech during the debate.
Ten hours have been set aside for the debate, which began shortly after 11 am and will continue without any lunch break.
The Modi government is expected to have a smooth sailing. In the 545-member (including the Speaker) Lok Sabha, the BJP-led NDA can bank on around 311 members, including the 273 of the BJP, Shiromani Akali Dal's (SAD's) 4, Lok Janshakti Party's (LJP's) 6, Rashtriya Lok Samta Party's (RLSP's) 3, Janata Dal (United)'s (JD-U's) 2, Apna Dal's 2, All India N R Congress' 1, Sikkim Democratic Front's (SDF's) 1, and Nationalist Democratic Progressive Party's (NDPP's) 1.
