Maharashtra govt formation LIVE: Guv appoints Kolambkar as pro-tem speaker

In dramatic twist to political events in Maharashtra, Devendra Fadnavis on Tuesday resigned as chief minister, announcing his decision at a press conference in Mumbai.

"My best wishes to whoever wants to form the next government," he said, clearing the way for the Shiv Sena, Nationalist Congress Party (NCP) and the Congress party.
Fadnavis gave up his post after Supreme Court this morning asked him to face a floor test on Wednesday. His deputy, Ajit Pawar of the NCP, had resigned minutes before.

Stating that Shiv Sena was not a religion-based party and originated to serve and fight for the rights of the people of Maharashtra, senior NCP leader Nawab Malik on Tuesday said allying with the BJP had "spoiled" the party.

Addressing media persons after Devendra Fadnavis stepped down from the chief minister's post, Malik said that the Shiv Sena-NCP-Congress combine will form the government in the state and will last for a long time.

"Let me make it clear that Shiv Sena was not formed for religion-based politics. When the Shiv Sena was formed, it was formed in the interests of Maharashtra and to fight for the people of the state," he said.

"BJP had spoiled it (Shiv Sena)," he said, adding that the next government will follow the ideals of Chhatrapati Shivaji Maharaj.

The Congress on Tuesday said Maharashtra governor Bhagat Singh Koshi yari should shed his RSS-BJP cloak and invite its alliance with the Shiv Sena and the NCP to form the government in the state.

Congress spokesperson Manish Tewari also said the turn of events in Maharashtra has put the role of the President under scanner.

"We hope the governor will fulfil his duties and invite 'Maha Vikas Aghadi' of Sena-NCP-Congress to form a stable government in Maharashtra... The governor sheds his RSS-BJP cloak," Tewari told a press conference.

Maha Guv appoints BJP's Kolambkar as Assembly pro-tem speaker
Maharashtra Governor Bhagat Singh Koshyari on Tuesday appointed BJP MLA Kalidas Kolambkar as pro-tem Speaker of the Assembly.

Eight-time Wadala MLA Kolambkar was one of the candidates recommended for the post to the governor.

"The governor has administered oath to Kolambkar as pro-tem speaker of the assembly. Kolambkar will administer oath to remaining 287 MLAs during the assembly session," said an official from Raj Bhavan.

Earlier in the day, ordering a floor test for the Devendra Fadnavis government, the Supreme Court asked Koshyari to appoint a pro-tem speaker and ensure all elected members of the House are sworn in on Wednesday.

Maharashtra floor test best gift to nation on Constitution Day: Sena lawyers
The Supreme Court gave the best gift to the nation on the Constitution Day on Tuesday by ordering the floor test in the Maharashtra Assembly tomorrow, said the lawyers for the Shiv Sena-NCP-Congress combine which challenged the Governor's decision allowing Devendra Fadnavis to form the government in the state.

Upbeat over the order, senior advocate Abhishek Manu Singhvi, appearing for the NCP and the Congress, thanked the apex court for its order and said that the entire political episode was the lowest level of morality and constitutional values which has all happened due to BJP.

"Today on Constitution Day, this is the best gift to the nation from the Supreme Court. We thank the apex court that the Saturday's plea was heard immediately on Sunday, again on Monday and tomorrow by 5 pm the floor test has to be conducted," Singhvi said.

Maharashtra govt formation: PM Modi meets Amit Shah, J P Nadda
Prime Minister Narendra Modi held a meeting on Tuesday with BJP chief Amit Shah, who is also the Union home minister, and the party's working president J P Nadda after the Supreme Court ordered a floor test in the Maharashtra Assembly on Wednesday.

Though there was no official word on what transpired in the meeting, the leaders are believed to have deliberated on the Maharashtra situation.

The rival Shiv Sena-NCP-Congress alliance has expressed confidence of having a majority in the 288-member assembly, insisting that the Devendra Fadnavis government lacks the requisite number.

Maharashtra crisis: SC refers to previous judgements on floor test
While ordering floor test for Maharashtra CM Devendra Fadnavis, the Supreme Court Tuesday referred to its past decisions on Karnataka, Uttarakhand, Uttar Pradesh and Jharkhand where it had ordered similar exercise in times of political crisis.

The first decision it mentioned was upholding the disqualification of 17 Congress-JD(S) MLAs in Karnataka by the then Assembly Speaker, which was pronounced on November 13 by the 3-judge bench led by Justice N V Ramana.

Justice Ramana also headed the 3-judge bench in the Maharashtra matter and referred to the Karnataka judgment which had emphasised the requirement of imbibing constitutional morality by constitutional functionaries.

The apex court also mentioned its 2016 verdict in the case of Union of India vs Harish Chandra Singh Rawat in which it ordered the former chief minister of Uttarakhand to take a 'vote of confidence' on the floor of the Assembly.

Senior-most MLA should be made pro-tem speaker, says Congress
The Congress on Tuesday called for the appointment of the senior-most lawmaker in Maharashtra Assembly as pro-tem speaker, saying precedents and conventions should be followed.

The party's assertion comes ahead of the Maharashtra Assembly floor test on Wednesday after the Supreme Court gave directions for holding it on Wednesday.

"It has happened in nine cases. If you remember in Karnataka, first K G Bopaiah ji was made speaker, but then he was changed as he was not senior-most. So automatically, it is a tradition that the senior-most (legislator) is made pro-tem speaker. We go by conventions and traditions," Congress spokesperson Abhishek Singhvi told reporters.
